Any way the wind blows

November 10, 2008

Arnold Swarzenegger: I think marriage should be just between a man and a woman, but the people of California should decide. Then, with Proposition 8, the people do decide, and:

“It’s unfortunate, obviously, but it’s not the end,” Schwarzenegger told CNN. “I think that we will again maybe undo that, if the court is willing to do that, and then move forward from there and again lead in that area.”

[. . .]

He told backers of same-sex marriage they “should never give up.”

That’s not too incoherent, is it? Maybe that’s what it takes to be governor of California. I’ve never been a fan of rule by referendum because it thwarts the intent of republicanism to remove lawmaking one step from the electorate to protect minority interests from the whims of the majority. And it’s far worse to tell people they have the last say, then urge courts to overturn them when they don’t get it right. It’s an interesting question whether gays are a “minority” in the original sense of the word and whether marriage is a “right” that needs protecting. But California’s nutty anemocracy won’t get the question addressed.
